1. Acceptance of Terms

By accessing or using Hailoom ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We may modify these Terms at any time. We'll notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

You must be at least 16 years old to use Hailoom. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration & Security

To use Hailoom, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

You may not share your account credentials or allow others to access your account. You are solely responsible for maintaining the security of your account.

Security Recommendation:

Enable two-factor authentication (MFA) to add an extra layer of security to your account.

3. Your Content & Ownership

Your Ownership

You retain all ownership rights to the content you upload to Hailoom ("Your Content"). This includes photos, videos, text, documents, and any other materials you store in your vaults.

License You Grant Us

By uploading content, you grant Hailoom a limited license to:

  • Store and encrypt your content on our servers
  • Display your content back to you and beneficiaries you designate
  • Perform technical operations (backups, format conversions for display)
  • Deliver scheduled content to beneficiaries as per your instructions

Important:

We never claim ownership of your content. We never use your content for advertising or sell it to third parties. Our license is strictly limited to providing the Service to you.

Your Responsibilities

You represent and warrant that:

  • You own or have the necessary rights to upload Your Content
  • Your Content does not violate any laws or third-party rights
  • Your Content does not contain malware, viruses, or harmful code
  • Your Content does not include illegal, defamatory, or harmful material

AI Writing Assistance

Hailoom offers an optional AI Writing Coach powered by third-party AI providers (Anthropic Claude for premium users, OpenAI for free-tier users). When you use this feature, your text prompt and content context are sent to the AI provider for real-time suggestions. Your content is processed on-demand and is never used to train AI models. You can use Hailoom without any AI features β€” the Writing Coach is entirely optional.

4. Acceptable Use Policy

You agree not to use Hailoom to:

  • Violate any laws, regulations, or third-party rights
  • Upload illegal, harmful, threatening, or abusive content
  • Harass, intimidate, or harm others
  • Impersonate any person or entity
  • Distribute spam, malware, or viruses
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service or servers
  • Use the Service for commercial purposes without our permission
  • Scrape, data mine, or use automated tools to access the Service
  • Reverse engineer or attempt to extract source code

We reserve the right to investigate violations and take appropriate action, including removing content, suspending or terminating accounts, and reporting to law enforcement.

5. Service Availability & Modifications

We strive to provide reliable service, but we cannot guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance and updates
  • Emergency repairs or technical issues
  • Events beyond our control (power outages, natural disasters, etc.)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable for any modifications, suspensions, or discontinuations.

We strongly recommend maintaining your own backups of important content. While we implement robust backup systems, you are ultimately responsible for preserving your data.

6. Payment Terms & Subscriptions

Free and Paid Plans

Hailoom offers both free and paid subscription plans. Free plans have storage and feature limitations. Premium plans require payment of subscription fees.

Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are in USD unless otherwise stated
  • Fees are non-refundable except as required by law or our refund policy
  • We may change pricing with 30 days' notice
  • Your subscription auto-renews unless you cancel

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You'll retain access to premium features until then.

Refund Policy

We offer a 30-day money-back guarantee for first-time premium subscribers. Contact support within 30 days of your initial purchase for a full refund.

7. Account Termination

Your Right to Terminate

You may delete your account at any time from your account settings. Upon deletion:

  • Your content will be permanently deleted within 30 days
  • Beneficiary access to shared content will be revoked
  • Any scheduled deliveries will be canceled
  • This action is irreversible

Our Right to Terminate

We may suspend or terminate your account if:

  • You violate these Terms or our Acceptable Use Policy
  • You fail to pay subscription fees
  • Your account is inactive for an extended period (free accounts only)
  • Required by law or legal process
  • We reasonably believe termination is necessary to protect our rights or others

We'll provide reasonable notice before termination when possible and legally permitted.

8. Disclaimers & Limitations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by law, Hailoom disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will meet your specific requirements

You use the Service at your own risk. We are not responsible for any loss of data, content, or information stored in your account, except as required by law.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAILOOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes damages for loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Unauthorized access to your account or content
  • Errors, bugs, or interruptions in the Service
  • Loss or corruption of content
  • Actions of third parties

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months prior to the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Dispute Resolution & Governing Law

Governing Law

These Terms are governed by the laws of the Grand Duchy of Luxembourg and applicable European Union regulations, without regard to conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through mediation or arbitration in Luxembourg, except you may bring claims in the courts of your country of residence if permitted by applicable consumer protection law.

Arbitration will be conducted under the rules of the Centre de MΓ©diation Civile et Commerciale de Luxembourg. The arbitrator's decision is final and binding.

Individual Resolution

You agree to resolve disputes individually unless mandatory consumer protection laws in your jurisdiction provide otherwise.

11. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and Hailoom regarding the Service.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment: You may not assign these Terms without our written consent. We may assign our rights and obligations without restriction.

Survival: Provisions that by their nature should survive termination will survive, including ownership, disclaimers, and limitations of liability.

Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.

13. Death Verification & Content Release

Given the sensitive and irreversible nature of releasing a deceased user's digital legacy, Hailoom maintains a rigorous death verification process.

Reporting a Passing

Any person β€” whether a registered beneficiary, family member, friend, or legal representative β€” may report a user's passing through our dedicated form. The reporter must provide a mandatory death certificate (PDF, JPEG, or PNG format), information about the deceased, and their own contact details. Optionally, funeral home information and obituary URLs may be provided to accelerate verification.

Verification Process

Each death notification is evaluated using a weighted multi-factor verification system:

  • Document Authenticity (35%): The uploaded death certificate is analyzed for validity through OCR and authenticity checks
  • Reporter Identity (25%): The reporter's email is verified and their relationship to the deceased is assessed, including whether they are a registered beneficiary
  • Public Records (25%): Obituaries, funeral home information, and other public sources are cross-referenced for corroboration
  • Temporal Consistency (10%): The reported dates and account activity patterns are checked for logical consistency
  • Multiple Reporters (5%): Additional independent reports from other sources strengthen the overall confidence score

Verification Decisions

Confidence scores of 90 or above with no failed factors may qualify for streamlined approval. Scores below 30 or with three or more failed factors result in rejection. All other cases undergo manual review by a trained administrator. Rejected reporters may appeal by providing additional documentation within 30 days.

Content Release

Beneficiary content is released only after the verification process is fully completed and an administrator has approved the notification. Beneficiaries are notified by email with a secure access code to view the content designated for them. Content is delivered as read-only to preserve the creator's original intent.

Fraudulent Reports

Submitting a fraudulent death notification is a serious offense. Hailoom reserves the right to: report fraudulent claims to law enforcement authorities, pursue legal action for damages, permanently ban the reporter from all Hailoom services, and share evidence with relevant authorities. Filing a false death notification may constitute fraud under applicable law.

Verification Data Retention

Death verification documents, reporter information, and audit logs are retained for 7 years from the date of verification completion, as required for legal compliance and fraud prevention. After this period, verification data is securely deleted. During the retention period, this data is accessible only to authorized administrators and legal counsel.
